By downloading, installing, or using Obsession Tracker ™ ("the App"), you agree to these Terms of Service. If you don't agree, don't use the App. These terms apply to both Free and Premium tiers.
Obsession Tracker ™ is a GPS tracking app for treasure hunters, metal detectorists, and outdoor enthusiasts. The App provides:

Prices may vary by region and are subject to change. You'll be notified of price changes before renewal.
We offer a 7-day free trial for Premium. You won't be charged during the trial. If you don't cancel before the trial ends, you'll automatically be charged for the subscription period you selected (annual or monthly).
Subscriptions auto-renew at the end of each billing period (annual or monthly) unless you cancel. You'll be charged 24 hours before renewal. Manage your subscription in your App Store (iOS) or Google Play (Android) account settings.
Cancel anytime through your App Store or Google Play account. Cancellation takes effect at the end of your current billing period. You'll retain Premium access until then. No refunds for partial periods.
All payments are processed by Apple/Google. Refund requests must go through them. We don't control or process refunds directly. See Apple's refund policy or Google's refund policy.
You are responsible for complying with all laws and regulations related to treasure hunting, metal detecting, and land access, including:

Obsession Tracker ™ is an independent application and is NOT affiliated with, endorsed by, or connected to any government agency, including but not limited to the U.S. Forest Service, Bureau of Land Management, National Park Service, U.S. Fish & Wildlife Service, or U.S. Geological Survey.

You acknowledge that outdoor activities carry inherent risks and that no app can guarantee your safety or legal compliance. The App is a tool to assist you—not a substitute for professional judgment, official verification, or common sense.
IMPORTANT: By using Obsession Tracker ™, you acknowledge:
IN NO EVENT SHALL Obsession Community LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless Obsession Community LLC, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to attorney's fees) arising from:
Before filing any formal dispute, you agree to first contact us at support@obsessiontracker.com and attempt to resolve the dispute informally for at least 30 days.
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware or, at your election, via telephone or video conference.
You understand that by agreeing to arbitration, you are waiving your right to a jury trial and to participate in a class action lawsuit.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class action lawsuits or class-wide arbitration against Obsession Community LLC.
If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and all disputes shall be resolved in the state or federal courts of Delaware.
Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
Obsession Tracker ™ and all content, features, and functionality are owned by Obsession Community LLC and protected by copyright, trademark, and other intellectual property laws.
Your Content: You retain ownership of your tracking data, photos, and waypoints. You grant us no rights to this data. We don't store it on our servers (privacy-first architecture).
We reserve the right to suspend or terminate your access to the App (including Premium features) if you:
Termination for violations does not entitle you to a refund.
Obsession Tracker ™ integrates with third-party services:
These services have their own terms of service and privacy policies. We're not responsible for their actions or policies.
We may update these Terms of Service to reflect changes in our practices, legal requirements, or new features. We'll notify you via the App or this website. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in Delaware courts.
